At this point it is up to the Judge to decide.

I would say that Section 166 protest remedies are already ongoing. There has been no attempts to delay these counts that I see other than the Republican Member of the Canvassing Board in Palm Beach wanting to delay the vote early Saturday morning until Monday until after he had gotten advice from the Office of the Secretary of State - Katherine Harris. (Just what do you think her advice would have been?)

So since the Democrats are the ones here seeking to move forward expeditiously and the Republicans are looking to chop it off at the knees, so that they can invoke statutory time limits, I would say that the Gore team has a strong hand.

Even if they don't get the time limit rolled back until there can be a fair and accurate accounting of the people's will, they can Contest and from what I see almost surely get any additional votes factored in, if those votes are determinative.
