No, Gore doesn't have anything close to a constitutional claim either at this point. Presumably Florida election law should control here but we are seeing that even that is controlled by partisan politics as the republican says the law requires one thing and the democrats another. The battle now is really in the court of public opinion but whoever wins at this point is going to be accused of stealing the election by partisans on the other side.
