Mr. Howe: A Copy of The Lawsuit Challenging the Ballot Is Available From CNN. Among the allegations are that the ballot failed to conform to Florida Statute 101.191 ("Form of General Election Ballot") which requires each candidate to be listed vertically from top to bottom in the same margin, and that it also violated Florida Statute 101.151(4)and 101.191 because it did not list the candidates in the order required based on the previous election for Governor, i.e., Gore/Lieberman should have been next in order after Bush/Cheney. Judge LaBarga will decide on Friday whether Florida law was broken in the way the ballot was formatted and he will decide whether it matters. My view is that the ballot did not comply with these statutes. And I expect the Court will so rule. However, the Court may also rule that the error was not sufficiently material to invalidate the election and that other laws are more important to enforce. We will just have to wait and see. However, to simply assert that the ballot DID NOT break Florida law is quite wrong. It is more likely that the ballot will be found to have violated Florida law.
