Her decision was based on advice of counsel, and appears to have a solid basis in the law. She has the discretion to refuse to count late votes and from what I've seen, there has been no cogent reason from the counties why they didn't get the count done by the deadline. Why West Palm Beach waited until the day after the statutory deadline to even begin a count is beyond me.

Volusia County did it right. They started their count and got it done, and I belive the Secretary of State is counting the votes from that hand count.

A challenge based on abuse of discretion is a hard one to make. The only way the counties win this one is if the state Supreme Court is stacked with democrat judges.

BTW, did you get your resume in for a position on Hillary's staff?
