Florida Supreme Court OKs recounts cnn.com
Florida Secretary of State Katherine Harris, told the Supreme Court today that she -- not the high court -- has the authority to make decisions on allowing hand counts.
The Supreme Court's order did not say that Harris must consider the new recounts and it remains unclear what impact new vote tallies might have on the presidential election.
This story refers to cnn.com in which Harris invokes legal infallibility, a doctrine I was previously unfamiliar with, except wrt a certain alleged IP company:
In her response, Harris said, the Florida Supreme Court "has no jurisdiction" to allow Palm Beach County to begin a recount.
She said there was no need to decide between her opinion and Butterworth's because Florida law provides her opinion "is binding upon the board" and the court must defer to her opinion.
Further, Harris said her staff has correctly construed the Florida law, while Butterworth's interpretation is "erroneous." (from cnn.com
I'm right, you're wrong, nyah nyah nyah. Sound like a good reason to go to court to me, although it also sounds like Ms. Harris would be perfectly comfortable ignoring a ruling from the state Supreme Court too.

The Supreme Court, whose seven members were all appointed by Democratic governors, said that based on the decisions in lower courts in Leon and Palm Beach counties, Palm Beach County officials could restart the hand count.
``At present, this is bending legal authority on the issue and there is no legal impediment to the recounts continuing,'' the Supreme Court order said. ``Thus, Petitioners are authorized to proceed with the manual recount.''
All seven members of the Supreme Court signed on to the ruling, but noted that it was only an interim order focusing only on the narrow issue of whether Palm Beach could restart their manual recount.
