Perhaps the greatest fear in Bush's camp is that Florida's Supreme Court will order the state's secretary of state to certify late vote results from manual recounts. GOP insiders say Bush's lawyers are prepared to argue, on separation-of-powers grounds, that the Supreme Court may not substitute its judgment for that of an executive branch official--the secretary of state--who is carrying out her lawful duties.

They will assert that she is legally required to certify the results when the overseas absentees are tabulated, and that she has discretion to make the rulings she has made on hand-counted ballots.

LaHood, the GOP congressman, said: "I think people recognize that the Florida Supreme Court is made up of a majority of Democrats, and people question that as much as they question that [Katherine Harris] is a Republican secretary of state."

A setback in the Florida Supreme Court could put Bush's fate in the U.S. 11th Circuit Court of Appeals in Atlanta, where Republicans have asked the manual recounts to be blocked. Some GOP lawyers see that as a long shot, but they believe the 12 judges will give them a fair hearing.
