Dear Eski and all: I am a Republican and I voted for Bush. However, I have faith that Judge Lewis's verdict will not be overturned on appeal. I myself once took a case to the Fla. Supreme Court and I can tell you it is next to impossible to get a circuit court judge overturned. Judge Lewis isnt just any old judge, he is widely considered to be fair and impartial and highly intelligent. In fact, it is my understanding he is on the fast track to the Fla. Supreme Court himself. Knowing all of that here is what would be required to overturn him.
Judge Lewis would have to be shown to have acted Capriciously in his decission that the Fla. State Canvassing Board did not act Arbitrarily in denying the hand counted votes. I would be SHOCKED if the Supreme Court who also is known as fair and impartial would find that Judge Lewis acted Capriciously. There will be plenty of spin put on this by both sides, but my prediction is Judge Lewis's decision will be upheld. JDN
