Yes, of course he is appealing. But IMHO he has a near impossible task of winning on appeal. I myself have taken a case all the way to the Fla. Supreme Court and I can tell you it is next to impossible to overturn a Circuit Court Judge. In order to overturn him they will have to PROVE that Judge Lewis acted Capriciously in ruling that the Fla. State Canvassing Board (Ms. Hariss is only one of THREE members on it) did NOT act arbitrarily in finding that the law does not allow her to rule out the hand counted ballots under the circumstances. Now, I will tell you all that are not from Fla. Judge Lewis isnt just any old judge. He is WIDELY REGARDED as fair and impartial and extremely intelligent. In fact it has been rumored for some time that he was on the fast track to Supreme Court himself. You will hear a lot of FUD about this but I will state right here and now I will be SHOCKED if this court found him Capricious. I also would be shocked if the Supreme Court which is SWORN TO UPHELD FLORIDA LAW attempts to perform an act only performable by our state Legislature and that is to ENACT LAW. Judge Lewis found he couldnt do it and I believe they will also. You may not like the law but we have to follow the law. the law may get overturned in the future BY THE LEGISLATURE but for now it is our law and will govern THIS election---THANK GOD. If you truly understood what is going on in S. Fla. I am quite sure you all would agree with me that to trust those hand counts would be a big mistake. JDN
