I believe this will ultimately be the outcome but they will disallow based on the 14th amendment, equal protection under the law. The votes in the Republican leaning counties clearly would not carry the same weight because the total would contain errors that the heavily democratic counties don't suffer. A Republican vote would not equal a Democratic vote.
