If they rule against the the Secretary, they will be unsurping the legislative process and taking more power than that which is granted them. Their job is not to make law, but to ensure it is followed.

Should be interesting to see whether the nearly all Democratic court will follow the rule of law, or find an excuse (for political reasons) to break it.
