The problem with that approach is that it is not "equal treatment under the law" and it ends up raising constitutional questions because it disadvantages voters other counties in the state of Florida.

If the Supreme court of Florida forces the Secretary of State to include only the extra votes gleaned from the "invalid machine votes" then every county in the state should be required to hand count their invalid votes as well. Unfortunately, that is against Florida law. Moreover,
the inclusion of the late hand count votes is also against Florida law.

If the Supreme court overrules the Secretary of State, it is also overruling the legislature of Florida which wrote the law. It would in effect be "legislating new election law". This create a constitutional crisis in Florida and probably force the issue into the US Federal court.
