There is no "right" to seek happiness in the Constitution. I think you've muddled up the declaration of independence with the Constitution. You might want to read both before you decide to pontificate.

Further, if you knew anything about Con law you would know that different constitutional scholars can come to diametrically opposed opinions on the same issue- it all depends on what view you start out with and where you want to end up. Law, and people are arbitrary and capricious. So it has been and so it will always be.
