The court rulings so far have made it clear that her decision was not cut-and-dried, but rather a matter of discretion. It is the exercise of discretion by someone who has something to gain from the decision which is a problem.

Doesn't it bother you even a little bit that someone who has publicly indicated a strong desire for a cabinet position in a Bush administration is the one who is making discretionary decisions which could have the effect of deciding the election?

Let me ask you this: Suppose she were the co-chair of the Gore campaign in Florida, and suppose that when the judge said she had discretion to allow late returns, she had exercised that discretion by accepting the late returns from the Democratic-dominated counties. Would that have been OK with you?
