The phrase "Rule of Law" has been invoked many times in the aftermath of the Florida mess. It appears to me that most people think that Rule of Law means that as long as well established legal procedures are followed, we are following the Rule of Law. This new definition of Rule of Law follows the same type of semantic confusion that has made socialist to be called a liberal and a reactionary to be called conservative.

If there are many contradictions in the Florida statutes, Rule of Law does not prevail in Florida. From Bruno Leoni again, for Rule fo Law to prevail, law must satisfy three general criteria. 1. It must be general.
2. It must confirm to the principle of equal justice
for all citizens. 3. It must be certain.

Generality means that when a law is enacted, it must not single out any special individual or group. Certainty means that the law must have a great degree of permanence and not be contradictory. The explosion of statutory leads to deterioration of the Rule of Law.
