I think, even though there are three people deciding, since the 2 of 3 or 3 of 3 (depending on which county) are Democrats, they are the same as one person. Meaning, that even though a vote is taken, the outcome is usually pretty certain. I would agree that I have not heard that any of them were working on the Gore campaign. If Harris recused herself, wouldn't another Republican be next in line to be in charge of that duty? And then wouldn't that person's party affiliation come into play also? Or would a Democrat then be in that position. Would that be any better?
As far as the power of Harris vs. the Commissioner's, I would say that if the Supreme Court rules in favor of Harris, then you are right, she was key, if they rule against her, then she becomes powerless, and the Commisioner's have all the power. Right now the re-count is looking like it will not produce enough Gore votes for him to win, however, that does not include thousands of disputed ballots. The people who decide who those disputed ballots go to, are those commisioner's. So in essence they will have the power to decide the outcome of the election, not Harris.
