When the question was "FL law allowance for recounts vs. the Tuesday submission deadline" all the Reps were weighing in with the fact that the SOS had no choice. Now that the laws conflict on a Bush question, discretion suddenly becomes the better part of valor.

There is a big difference. The law on machine recounts, certification deadline and SOS flexibility in accepting late submissions is consistent. The legislator who is the author of the bill said that the intention of the law about manual recounts is in case the machinery malfunctions, and SOS was perfectly willing to accept late returns in case of mulfunction.

On the other hand, the contradiction between federal and state law in postmarks is not really a contradiction. One law supersedes the other. I am not 100% sure but I think the federal law supersedes the state law in this instance.

Maybe I will look it up.
