So who then decides if due process of law was achieved?

If the FL Supreme Court's action causes Gore to be ahead on Sunday at the "end of the count" and consequently the Gore electors are elected, first the Florida legislature will decide to send their own set of electors to DC; and then Congress will have to decide which electors to count.

I've got to reread my copy of the Constitution again to see what it says about that scenario.

And simultaneously, the Bush side might continue to litigate the Constitutional issue all the way to the Supreme Court.

Bottom line is Congress and/or the Supreme Court will choose the next President.
