The constitution has never backed dicatatorial powers. I read a quote today from Stalin that said he who counts the votes has absolute power (it was from a Rep so I can't testify to its veracity). Ms Harris thought she had the absolute power to count the votes she wanted to count, fortunately unlike the old Soviet Republic Florida had a Supreme court that said otherwise.
