I'd expect the US Supreme Court to consider it a state matter and send it back, perhaps with a carefully constructed suggestion or two that the state court might consider.

The state court and the state legislature are likely to be the two bodies that bring the matter to a conclusion. With the EC meeting not far off, time grows very short, however.
