The table of contents is unequivocal whereas the article only infers. Most likely the table of contents was written by an editor who never checked with Einhorn to make sure that they could say with such certainty that the FBI is investigating PLMD. Whereas the article I think is written so that the company cannot be sued, the blurb in the t.o.c. is definitely actionable.

In other words, the article is very careful about who they quote, and it basically says, "Barron's believes the FBI is investigating PLMD based on what we've learned from other government sources, and because we believe the management is trying to trick people with their accounting, and because the insiders sold some shares recently." You can't sue Barron's for saying that. But the table of contents makes a claim of fact that, if it's not true, can be used as the basis of a libel suit. I'm amazed actually that Barron's was so stupid in their editing. Again, the make a claim of fact about the FBI in that blurb, whereas the article only voices a belief about the FBI. There's a huge legal difference.
