They didn't agree to hear Question 3 because the issue was pending before the 11th Circuit and therefore the issue was not ripe. They denied the expedited appeal from the 11th Circuit without prejudice.

If the US Supreme Court finds that the Florida Supreme Court violated 3 USC 5, then Sec. Harris has the right to exclude the amended returns. The Florida Supreme Court did not find that she abused her discretion. The more I think about it, the more I think that if I were standing in her shoes, I simply would not certify the election until the U.S. Supreme Court rules.
