It takes 4 votes for the Supreme Court to agree to put a case on their docket. For a case to receive expedited consideration like this one it takes 5 votes. 5 of the justices voted to hear the case to determine whether recounts are unconstitutional.

It has been reported by most news agencies that this was a victory for Bush but even though I am a democrat I was happy to hear of the Courts decision. The Supreme Court is less biased than any court the candidates have been in front of yet for the simple reason that they don't have to stand for re-election.

It wouldn't surprise me one bit if the court doesn't do exactly as the Florida court did and rule on issues that weren't even mentioned in the filing.

I will be very surprised if they rule in favor of Bush.
