You may be right about the four, but I'm pretty sure they wouldn't have given cert if they hadn't gotten at least one or two other justices to agree that cert should be taken. If an informal poll convinced them they would lose 5-4, I doubt they would have gotten the SC involved. They're partisan, but they also respect the traditions and honor of the Court, and I don't think any of them, particularly Rehnquist as CJ, would sacrifice that lightly by taking the case and then losing on a 5-4 ruling.
