Bush filed the appeal when the outcome in Florida was very much more in doubt than it is now (it is still in some doubt, but not as much). It surely looked last Tuesday night like a hand recount in those counties was going to turn up hundreds if not thousands of "votes" for Gore..... and then Bush's only recourse would have been to the Supreme Court (or to have the Florida Legislature provoke a Constitutional crisis). Even now, he is subject to the possibility that Florida courts will allow further selective recounts. His lead is really less than 400 votes, because Palm Beach's barely late recount conjured up a couple hundred for Gore if I recall correctly.

So Bush's action in the Supreme Court is basically to cover his flank. He is exhausting the supply of new votes for himself, because it appears that his have already been counted. That leaves Gore to troll for votes through arguments about "uncounted" ballots and the like. If Bush wants to play the game to "win" the "prize" -- something I have felt all along he should not do -- then the Supreme Court action makes sense.

I noticed yesterday that Cheney announced it would be appropriate to have some Democrats in the cabinet. He basically gave a version of the message I wrote on the Piffer OT thread a couple days after the election -- the election shows a divided country, a mandate for nobody, and let's invite Democrats into the cabinet too. Sam Nunn's name was floated, as were a couple other people I had never heard of. If that kind of rhetoric continues, it is a good sign IMO.
