To be honest, I didn't read the article as I was out of the country. I will make time this week to get the article and read it. However, my reserved comments would be that any liability exposure would have to take into account the overall tone of the article...not just the "tease line" that sadly most media sources use to draw you into reading or listening to their article or news items.(To be honest..this drives me crazy when the TV/Radio announcer gives his tease line and then you have to wait 30 minutes to get the full story).
As for Einhorn, she is the regular reporter for the commodity section of Barron's and she is often seen on CNBC...which I would assume is reserved for the more respected Barron's reporters to appear there. I only spoke directly with her on one occasion and she came over as a very serious reporter. When she does write feature articles as opposed to the commodity feature each week, it appears that she always has the "goods" on the company she is writing about.
One can be harsh with Barron's, but to castigate them for the articles that merely report what other analyst or fund managers are saying isn't being fair to Barron's being merely the source for delivering what others are saying and believing about the economy or individual companies. However, when a Barron's reporter is doing the individual interpretation of a company(whether good or bad), you can be assured that some of the best legal attorneys familar with libel laws have read and re-read the article before it is published. You can bank on that!
Just to give you other example of Barron's doing a job on a company and management, one only has to look back at Sunbeam. At the time Chainsaw Al was the fairheaded boy of corporate restructing and could do no wrong. Look at what Sunbeam's stock had done since his take-over and then Barron's came out with their article about the questionable accounting...initially Barron's took a lot of heat over this article since they had dared to question someone of Dunlop reputation....bottomline! You can today buy Sunbeam for under a dollar and appears that Dunlops troubles are just beginning with potential criminal charges being made against him. Don't you know that he loves Barron's!
