I was not aware that the constitution addresses this issue... where? or is that an interpretation by our courts?

The key word there is overburdensome. I would say that within the leeway of that grey area lies the battleground. I do not think that background checks and waiting periods are overburdensome, especially in cities. I would be interested in how someone could argue that they are and still be within the spirit of the constitutional right.

BTW I have used a beautiful Baretta Shotgun to shoot skeet. It was fun :)

As far as the nuclear weapon argument goes, I was simply pointing out that the words right to bear arms are not absolute.
