the theory of the case

You either don't understand the case or misrepresent it.

The democratic case is simple : COUNT THE FRIGGIN VOTES. There are additional contests, Seminole, Butterflys, etc. but these are merely efforts to have Bush address the actual election, a bit of side persuasion.

The republicans do not have a case to stop the count. The compelling reason is that the margin of error in the punch card / card reader system is higher than the number of votes in question. The machine can tell us almost nothing about the actual results, just as a poll differing by a few points with a large margin of error can tell almost nothing about sentiment. The machine count only served the purpose to illustrate that the race was too close to count by machine. Call the expert witness, the machine makers, case closed!

The machine error also worked directly against Gore. The punch cards were in democratic counties, the more accurate optical scanners were in republican counties. There is a clear and compelling bias in the undercount.

Finally, the remedy is simple and fair. COUNT THE FRIGGIN VOTES.
