On a very quick read, it's hard for me to see how they can make this argument with a straight face. Particularly now that the case is practically moot, my prediction is that the Court will rule against them by 7-2 or more.

It's really very hard to argue that a state Supreme Court, interpreting a contradictory statute, is somehow violating a Federal statute requiring that controversies related to the appointment of electors be resolved under "laws enacted prior to election day."

It's pretty much a side-show as I see it, but it still should be entertaining.
