yes, there is a judge making that call. Unfortunately, as a trial lawyer, I don't have much confidence in Judges be able to overcome the delaying tactics of skilled lawyers. The trial process lends itself to delay with cross-examination, discovery, motions, objections, confusion etc. Under ordinary circumstances, the judge can just be patient and let the process work but, in this case, there is a constitutional deadline which cannot be extended so delay is much more effective. If the votes actually get counted, then the burden shifts to Bush. That is a big IF. My point is that Bush's short term strategy of getting elected will do long term harm to his Presidency.
