Because he can !!

I happened to catch C-Span2 on cable last night
and watched the Florida State legislature which
had convened a 'hearing' to educate itself on
Constitutional Law from a panel of 'experts' from
academia; the purpose of which was to determine the
likely course of future events and what options/
obligations were available/required of the Florida
State Legislature going forward ..

A Mr. Einer Eilague, professor at Harvard, spoke/advised
for a good hour on his 'take' of the situation and from
what I think I heard, the Dems are very close to setting
up a 'win' when the electoral college votes Dec 12th ..
One of the 'key' points he made that lead me to this
conclusion were the ramifications of having a 'contest' of a 'certified' election ..
which is the present situation .. The simple fact that
there is an unresolved 'contest' according to Eilague is sufficient 'reason' to enjoin the Florida electors from
participating in the Dec 12th vote .. regardless of wether
at this point the elector slate is the Dem slate, the
Republican slate, or a slate that the Florida legislature
must appoint itself by/before midnight Dec 11 th ..
It was his learned opinion from an examination of prior
'contests' of 'certified' elections that there was no
way that this particular contest would be 'legally'
settled by the Dec 11th midnight deadline .. Therefore,
per the Constitution, the electoral college will vote
Dec 12th without a "valid" Florida set of
electors .. Should this eventuality occur .. Gore
would win the electoral college 264 to 246 without
Florida's electors

I'm not a lawyer, but this fellow Eilague and a Mr. Voo from Stanford, I think, were in agreement with the above
scenario; They also felt that the Florida legislature
must by Federal Law appoint it's own slate of
electors on or before Dec 12th; with a high probabilty
that (a) there may not be enough time to conclude the
process if they started today, (b) that the State selected
electors would be easily challenged as to 'validity' ..
all because the Democrats have initiated a 'contest' to
a 'certified' election .. that was the key point ..

Hope I'm wrong ..
