FTC pushing Time Warner to open content, report says

It seems more likely than ever that America Online (AOL) and Time Warner (TWX) will have to defend their merger in court.

According to a report in USA Today, the Federal Trade Comission has insisted that the companies offer Time Warner content -- including movies, music, news and TV shows -- to other Internet portals at the same time it distributes that content to AOL. While Time Warner has pledged to offer its content throughout the Internet, analysts say Time Warner wants to give the content to AOL first.

And Time Warner now says it will go to court to protect its right to do that, according to the report. Meanwhile, the FTC is gearing up for a court battle to block the merger if its demand for open content is not met.

The FTC has successfully pressured AOL and Time Warner in the recent past. For months, the commission pressed the two companies to agree to open Time Warner cable networks to competing Internet access providers --providing so-called "open access" -- as a condition of the merger. Last week, Time Warner answered those demands, announcing a deal to share its cable network with AOL rival EarthLink (ELNK).

The FTC is expected to vote on the merger within two weeks.
