I think it makes more sense the way I have it. Say you've been long a stock ten years and sell in Jan 2002. You would pay 20% cap gains. But the guy who bought in Jan 2001 and sold in Jan 2002 would pay 18%. That just doesn't seem right.

OTOH, instead of your buyers strike in December, we may have an avalanche of sellers in January as people that have held this tech trash wait for a lower tax rate to get out.
