The best I saw was a former US SC clerk that was on earlier tonight. He said that the flaw (and weakness) of the Florida SC ruling was that it was results-based. He said that it appeared that the justices determined the desired result, and then worked the framework of their decision to accommodate it. That's the pure example of writing law from the bench (a violation of the separation of powers).

He said that the Bush case is solid, but that anything could happen. He seemed to think that they might not rule on it (like the 11th Circuit chose not to rule), given the fact that the result of the election has not been changed (yet). Yet he was most certain that the court will set some precedent, otherwise they would not have heard it.
