Jeb Bush was duly elected by the people of Florida too, yet he did the right thing and recused himself from the Elections Board because, as the brother of one of the candidates, he had a conflict of interest. Katherine Harris, being campaign co-chair for one of the candidates, also had a conflict of interest

Katherine Harris' discretion is really not an issue, since the FL SC extended the deadline by 12 days, essentially obviating the need for any use of discretion on her part.

the Circuit Court and the Fla. Supreme Court disagreed with you. They said she had discretion.

We should also keep in mind that a Democratic judge ruled in Katherine Harris' favor, yet was overturned by the FL SC, in essence writing new law. If the FLA Legislature had come out and passed a Law which replicated the exact SC ruling, I think everyone would agree that that was grossly unfair. Law cannot be changed after the fact to suit one party; I believe the US SC will rule this way sometime in the coming days.
