The more I think about it the less I understand why they took the case. If they confirm, they might seem to be tacitly approving Gore's tactics of counting every vote including those that were not cast. If they reverse, they make it appear that deadlines matter more than the right to vote, and make it seem like the right to vote can be obliterated by the failure of officials to carry out their duty to count the votes.

If I were them, I would focus on what would constitute the proper exercise of discretion to count after the seven day deadline. Yes, I know, the Bush partisans (and Bush himself) are saying the votes have already been counted, and recounted. Well, in New Mexico that was true, and more than 7 days after the election it was discovered that 500 or so votes had been miscounted, and it swung the state from one candidate to the other.
