I'm staying with my prediction yesterday of a 6-3 decision against Bush with Rehnquist, Scalia and Thomas dissenting.

" Comments from Souter, Ruth Bader Ginsburg and John Paul Stevens seemed to suggest support for upholding the state court’s ruling. Rehnquist and Scalia, on the other hand, seemed quite skeptical of the state court. Although Justice Clarence Thomas largely sat out of the lively debate, he usually votes in agreement with Scalia.
The remaining three justices, O’Connor, Anthony Kennedy and Breyer expressed the most concern as to whether the Supreme Court should even have heard the case."
