You can't always tell how a judge feels by the rulings he makes.

Lawyering 102 is how sit back and let the judge do what the judge is gonna do. You can lose all the procedural shootouts and still win on the merits. Boies is losing because he is advancing weak arguments. He still has some strong ones in the quiver.

In fact, if he loses a lot the judge may let him win some just to appear more fair.

It's all a game. And the better players see further to the eventual end-game. This stage is more like chess than football.
