Seems like the vote tabulation of the canvassing boards should be considered to be prima facie or presumptively correct but the decision of the canvassing board to not have a manual recount is a question of law as to whether an abuse of discretion occurred. Boies seems to have a good argument that an abuse of discretion occurred in that Miami-Dade's initial count had already shown a substantial and material change of the vote count. It seems to be strictly a question of law as to whether the shortness of time was a sufficient reason to deny a manual recount.
