One (maybe not so) little wrinkle in the Seminole case is that the infractions occurred BEFORE the election, so it's not clear to me that anyone could argue that throwing out those ballots would be a change in the rules AFTER the election. That said, if the lower court throws out those ballots, the Republicans would be in the FLSC arguing to change the rules AFTER the election, after going to the USSC aguing the reverse. If the lower court accepts those ballots, the Democrats will be the ones in the FLSC arguing that the rules CAN'T be changed AFTER the election.

OH, the irony!!
