I was thinking they didn't want to make the motion to strike for political reasons, that they did not want people to argue that the judge was biased. It's a terrible blow to tell a party that they haven't made a prima facie case. Letting all your own witnesses blow the case up on the facts makes for a good show. Only a lawyer would be satisfied with a motion to strike. The public expects a show.
