In a brisk exchange with the Gore mouthpiece, Professor Laurence Tribe, Justice O'Connor scoffed at the theory that the Florida court was simply engaging in some routine judicial review. It should have occurred to them, she remarked, "that it might be in the state's best interest not to go around changing the law after the election". (Daily Telegraph- UK)

The FLSC did change the law (cannot do) and did so after the election (definitely cannot do). Should (by all that is right and proper) be a 9-0 ruling, but will not be. I will be ok with a 5-4 ruling. Not sure I understand the pundits saying that such a vote would tear the divided country even further apart... The 4 judicial activists on the court are the problem, not the issue before the court.

Our founders purposefully made the Judicial branch of government the weakest. It's past time to steer back in that direction. Courts exist to rule on what already exists, not create what they think ought to exist.
