Please don't think you have to be a lawyer to debate here - if so, I wouldn't have anyone to debate with - except Christopher H., don't know whether he's made an appearance here yet or not.

I agree that in an ideal world Ahman (sp?) would not have said that a manual recount is more accurate, but that opinion isn't binding on the Court. He's a mechanical engineer, not a statistician, so he's using common sense and experience. But Bush's witnesses are testifying to the difference of opinions used by, really, every Canvassing Board involved in the manual recount process and even between the board members in some cases (Broward and Miami-Dade). Also Bush's witnesses have testified to the degradation that the ballots have suffered over time.

How can any manual recount be more accurate if the vote is in the eye of the beholder? How can any manual recount be more accurate if the ballots have been degraded?

Did Ahman testify about what happens in those situations? Or what happens in the lab?

But further, why should Sauls substitute his dicretion for that of the Miami-Dade board which decided not to recount?

Boies argues that there is no abuse-of-discretion standard - but has put on no competent evidence that should motivate Sauls to recount Miami-Dade.
