The grounds would be that they could affect the outcome of the election, and that there had been systematic errors with the original voting. I think Boies made his case on these points in his closing argument last night.

If Sauls doesn't allow the counts, I'd expect the FL SC to do so, but perhaps with the same lax standards that were used by M-D for the 1700 ballots. As a Republican, I'd rather risk losing the presidency to Gore than have a cloud hang forever over a Bush presidency if these ballots aren't looked at. My big problem with Gore's position is the obvious lack of standards and their push for the most liberal possible interpretation. FWIW I think Burton got it right.

The only way I could see Sauls not counting the M-D ballots would be on the grounds that these ballots could not possibly affect the outcome of the election, a very difficult position to take. About the only way you could argue that would be to accept the argument that examining just these few counties under a microscope while allowing undervotes elsewhere in the state to stand unexamined is unfair, and that the election outcome would not be changed if the entire state were similarly recounted.

In his close Boies didn't deny the possible lopsidedness of the selective counting, but argued that the failure of the Reps to contest undervotes elsewhere should not be allowed to limit his clients' rights.
