Hi SbH - I think these 9 justices are the best politicians [in a respectful way, of course] this land has produced. By setting the FLSC's ruling aside by saying the USSC doesn't fully understand the former's ground for its respective ruling, they are not saying the ruling was right or wrong, with a big maybe hanging out there. This is not an overrule by a normal sense of the concept. Therefore, no one can pin anything on the USSC's ruling. No one can accuse the "state right" advocates for being inconsistent and no one can use it as a case of precedent! At the same time, it will reign in any attempt by the state court to become an activist. Quite a master stroke!

The real question is how this ruling will impact Judge Sauls's ruling. Already, he has to postpone his judgement in light of this. Right now, VP Gore is not doing so good.
