If the FSC had no right to reset the date of the certification, I believe that equitable relief mandates a return to the status quo ante, i.e., what would have been the certification had the FSC not interfered. Now, it may be that the additional material is usable at trial, as you suggest, but I am not sure. It certainly weakens some of the cases, since if the FSC had no sufficient reason to interfere in the certification, the Gore campaign is unlikely to have any reason to question what has been certified, and if the argument for mandatory hand counts was not found compelling by the USSC, it is not likely to be compelling at a lower level. If one regards the USSC decision as a kind of guidance, it will have a marked effect on the contest......
