If you prepare properly, you know those questions are coming. Some judges excel at thinking of some inventive new twist, and that's when the fear really sets in.

I thought the Bush team had the much harder challenge in convincing the court that there was something wrong in having the Florida Supreme Court construe conflicting Florida statutes. That's the Fla. Supreme Court's job, not the U.S. Supreme Court's role. Today's ruling doesn't change that - they are asking the Fla. Sup. Ct. to explain what their reasoning was a little more logically, and if you read the transcript of the hearing last Friday it isn't hard to construct an opinion that the U.S. Supreme Court will be happy with.

The bad thing is that to write an opinion AND take it back up to Washington takes time. My guess is that the Florida Supreme Court issues an opinion by Thursday in favor of Gore and the U.S. Supreme Court does NOT grant cert a second time.
