I think in this case the Court, correctly, believes that it is important for a lopsided decision; 9-0 or 8-1. It's the only way the majority of the populace could accept the final result. I also think that the individual Justices may have very strong opinions, it's just divided. They're just hoping the FSC will give them something they can have a lopsided opinion on.
