You are correct re:Lieberman causing the composition of the Senate to become 51/49, so probably he would not be the choice of the Senate to be VP. How about Gore as VP? Could he vote for himself with the tie-breaking vote? That would leave the Senate the way it is.
I also agree with you regarding the USSC decision. I knew they would try to craft a unanimous decision instead of a 5-4 split, but couldn't imagine how they could avoid a split or how they would avoid getting caught in the political backwash, but they have done it. No one ever accused these Justices of being dumb.
As for Judge Saul, I note that the article you cited suggests that appealing to the FSC Saul's decision to have the trial on Saturday may not have been the way to win points with Saul. No judge likes having his every ruling questioned. Based on the speed with which he appealed I would guess that Bois knew Saul would rule against him. By the way, I have to admit that I was wrong about one thing, and that is that not all the judges in this case have acted in a partisan manner.
At this point it seems that Seminole County is the best hope for Gore. I'm not really clear on the facts of that case. I have heard at least a couple different versions and I don't know which, if any, are correct: 1. The voter ID numbers should have been printed on the application by the county prior to sending them to the voter for completion. 2. The numbers should not have been pre-printed and can only be filled in by the voter. 3. No Democrat applications were rejected for lack of a voter ID. 4. Some Democrat applications were rejected for lack of a voter ID. 5. The activists used their own database to get the voter ID numbers. 6. The activists used the state database to get the voter ID numbers.
Anyway, I suspect that as this case moves front-and-center we will hear more about the facts in both Seminole and Martin counties.
As for the mainline case (i.e. the election contest), I'm not sure where it goes from here. It would seem that Gore will need to get the FSC to issue a new decision in his favor in the first case, and then overrule Saul, so Gore will have to win the next two rounds in the FSC.
