Ashcroft is a great man...and he is also a very smart man.

1. The margin of victory for Carnahan in MO was 49,000 votes out of 2.34mm cast. The Bush lead in FL is under 600 votes out of 6 mm cast. By any standard, Carnahan was a landslide winner by comparison.

2. But for the fact that there was not time to print new ballots with a replacement candidate's name on it, you know that the Party would have honored Mel's supporters wishes and replaced his name with his widow. The Republican Party flaunted that the de joure nominee of the Dems was a dead man, but the de facto nominee was the widow. Everyone knows that, I don't even live in MO and I know that.

3. Ashcroft, in attempting to enforce the de joure issue that a dead man was technically on the ballot, would have been attempting to state that since the plane crash occurred before ballots could be changed, then the Democrats just couldn't have a nominee. That is the ugly little fact that noone has seemed to mention. The Republicans were saying that no Democrat could be a candidate.

4. Now, assuming I am totally full of it on everything above, there was one other little issue that probably overrides everything above. Ashcroft did a quick cost/benefit analysis and realized that to pursue this issue would have required that he drag the widow into court and attempt to disqualify her...very very bad Karma.

Now, I am not saying he wasn't gracious, but there were alot of other issues at play in the Show Me state besides the Senator's graciousness.
