With regard to Boies's jumping the channel to FSC before the case with Judge Sauls is done, he really had no choice b/c time is not on his side. Since Judge Sauls has built his response with statutory construction, no one can say he is unfair. From all the commentators I ve heard, the chance for the appeal doesn't look so good for the Gore camp at this point, especially with the USSC situation
Who would have thought the Seminole [and Martin] situation is becoming one of the better chances for the Gore camp! Well, actually Judge Kogan [a retired FSC chief judge who has been on NewsHour as a non partisan commentator] did mention that 2 weeks ago. However, the Gore folks will have a hot potato in their hands if they do win this case alone and thus the Presidency. Of course, the moderates like former Sen John Danforth are now spinning that this election is essentially a tie. So, that is a way out, but it will surely present an apparent contradiction!
